Overview

The Network for Public Health Law (www.networkforphl.org), with the support of its fiscal sponsor, TSNE, is a national organization providing leadership, legal technical assistance and educational resources to help public health practitioners, attorneys, policy makers, researchers, advocates, and communities develop, implement, and enforce laws to solve public health challenges.

Responsibilities

The Network is seeking a Senior Attorney to work remotely for its Mid-States Region. This position will focus on the legal and technical issues for the use and exchange of public health data, within the broader context of modernization initiatives for inter-governmental and healthcare data interoperability. As a Mid-States region team member, the attorney will provide legal technical assistance, assess compliance requirements under applicable law, conduct training and Webinars, and facilitate opportunities for networking and peer assistance on topics related to public health data to a variety of audiences, including state, local, tribal and territorial health departments. A preference may be given to attorneys who have prior experience in the drafting of data use agreements and application of relevant data standards, either in public health or healthcare contexts.

 

The Senior Attorney will work closely with all members of the Mid-States Region, as well as with team members from other regions and the national office. The Senior Attorney will help to identify funding opportunities, assist with grant proposals, help manage project contracts and project deliverables, and perform other duties as assigned.

 

The Mid-States Region is fully remote, with team members located across the country. Some travel is required for conferences, presentations, trainings, and meetings. The Region values collegiality, professionalism, and consensus in its work and operations.

 

Attorneys in good standing of the Bar of a U.S. jurisdiction with a minimum of five years of post-law school experience and demonstrated experience in healthcare or public health law, data privacy law, data standards and interoperability, or related legal experience are encouraged to apply.

 

 

Supervisory Responsibilities:

This position may supervise research assistants or law students on specific projects, or new attorneys who participate in Network fellowships.

 

Essential Functions

 

  • Legal Technical Assistance
    • Provide timely, high-quality, practical, and relevant technical assistance and training on data-related and other public health law projects, including referrals in consultation with Network colleagues.
    • Provide legal technical assistance, consulting, and recommendations for the Network’s projects portfolio.
    • Deliver public health law presentations, including in-person presentations and webinars.

 

  • Resource Development
    • Work directly with practitioners, attorneys, and other stakeholders on an ongoing basis to identify relevant legal issues and evidence-based solutions for data-related and other public health law matters.
    • Develop practical or scholarly Network resources for public health practitioners, attorneys, policy advocates, and other interested persons.
    • Contribute to a comprehensive repository of legal information, such as blogs, fact sheets, tool kits, and information briefs for the Network’s constituents.

 

  • Outreach and Relationship Building
    • Build and maintain collaborative relationships with public health and legal experts.
    • Represent the Network at conferences, in data-related stakeholder groups, and in other gatherings.
    • Provide opportunities for networking and peer assistance to Network stakeholders.
    • Participate in Network-wide committees and workgroups as appropriate.

 

  • Other duties as assigned.

Qualifications

We will consider exceptional candidates who demonstrate a strong combination of the specific qualifications and skills described below.

 

  • Minimum of five years of experience providing legal counsel or technical legal support in public health law, health law, or data privacy/security law (including experience with HIPAA, HITECH, or similar state, tribal, local and territorial data protection requirements);

or

  • Previous substantial responsibility in healthcare or public health for compliance with data privacy laws or other data governance requirements;

or

  • Meaningful experience in the drafting and implementation of commercial or inter-governmental health data use and exchange agreements;

or

  • Graduate level education regarding public health or healthcare data privacy and security, or related areas in place of one year of legal practice experience.

 

In addition, candidates must:

  • Be an attorney in good standing of the Bar of a U.S. jurisdiction;
  • Possess excellent legal research, writing, and public speaking skills;
  • Possess excellent organizational skills;
  • Have demonstrated ability to work independently;
  • Possess a commitment to health equity and social justice; and
  • Be able to create and maintain partnerships and collaborative relationships with a wide variety of individuals and communities.

 

Special requirements:

 

  • Ability to travel nationally as needed, typically 4 to 6 trips a year.

Compensation and Benefits

 

Location: Work will be primarily performed remote.

Compensation: The salary range for this position is $90,000 - $105,000/yr. and is commensurate with experience.
